Terms and Conditions

Wayfarers Contemporary Art Fair is a partnership of galleries based in the Wayfarers Arcade: Gallery More, Play On productions CIC, Modern Contemporary Gallery, The Northerner Gallery and The Wayfarers Arts. The partnership are the “Site” operator.
 
Wayfarers Contemporary Art Fair provides a service for viewing, selling and purchasing original works of art from galleries, artist collectives and artist/makers through live fairs (“Events”).
 
Please read the following carefully to understand our these Terms, the Privacy Policy, and any other policies linked to herein, govern your access to and use of the Services, and constitute a binding legal agreement between you and Wayfarers Contemporary Art Fair.
 
Your use of the Site constitutes your agreement to follow and be bound by these Terms. If you do not agree to these Terms, you should not access or use the Site. Please note that by attending or purchasing tickets to our Events, you agree to be bound by these Terms and the other documents expressly referred to in them. We reserve the right to make changes to the Site and to these Terms and Conditions from time to time. When we make changes, we will post them here. For this reason, we encourage you to review these Terms whenever you use our Site because, by visiting the Site, you agree to accept any such changes. Wayfarers Contemporary Art Fair provides you with access to and use of the Site subject to your compliance with the Terms.
 
The contents of the Website, such as text, graphics, images, audio, video, data, coding, scripts, computer programs and other material (“Material” or “Materials”), are protected by copyright under the laws of the United Kingdom as well as other countries, and are owned or controlled by the Company or by third parties that have licensed their Material to the Company. Please refer to point 5 below for our Image Use Rights.
 

How we use your personal information

  • We only use your personal information in accordance with our Privacy Policy which is detailed on our website.

Purchasing tickets

  • Entry try to the art fair is free, expecting the preview events. Nobody will be allowed admission into the preview event without a valid ticket or pass.
  • We use third-party ticketing agents for the purposes of selling tickets or providing passes to our Events. The ticket agent process all payments on our behalf. In addition to our Terms, by purchasing a ticket you agree to the terms and conditions outlined by our ticket agent.
  • You can pay for tickets in advance of the event by using a debit card or credit card or on in person on the door.
  • Please check your details carefully before submitting an order. If you think a payment has been debited from your bank account incorrectly, or any of your details are incorrect, please contact the art fair in the first instance: info@wayfarerscontemporaryartfair.com
  • Tickets can only be exchanged or refunded on a case-by-case basis. To request a refund or exchange after purchase, please contact: info@wayfarerscontemporaryartfair.com
  • In addition to the ticket price, the ticket agent may require payment of a booking fee per ticket, a transaction fee per order and/or other supplementary fees which may apply to the Event.
  • Should cancellation of the event be necessary we will contact all customers who have booked tickets to arrange an exchange or refund. This contact will be in the form of email, so you are advised to check your email inbox before visiting the Event to avoid an unnecessary journey should an event be cancelled.
  • In the event of a change of date, we will contact all customers who have booked tickets to inform them of the change. If you cannot make the new date, you will be entitled to a refund.
  • If the Event is rescheduled, changed, moved or cancelled the Organiser cannot be held responsible for any resulting costs you may incur for travel, accommodation and other related goods, services or compensation.

Conditions of entry and participation

All participants at the Event must adhere to the principles outlined in the code of conduct outlined below.  
The Organiser reserves the right to refuse admission or to eject any person appearing to be heavily intoxicated, under the influence of drugs, behaving dangerously or inappropriately, or for any other behaviour likely to cause damage, injury, nuisance and annoyance or for failure to comply with the reasonable request of the Organiser.
The Organiser does not accept any responsibility for any loss or damage to personal property brought to the Event.
Visitors may be filmed, photographed or sound recorded for broadcast, publication or security purposes whilst at the Event by the Organiser and our trusted sponsors and partners. For more information please see our privacy policy.
 

Code of Conduct

Wayfarers Contemporary Art Fair is committed to fostering a positive, inclusive environment where exhibitors, visitors, suppliers, partners and team members can engage respectfully and professionally.
 

To ensure this, all participants must adhere to the following code of conduct principles: 

– Treat everyone with kindness, courtesy and respect.
– Maintain professionalism in all interactions.
– Recognise and value the diverse backgrounds, experiences and beliefs of others.
– Follow all applicable safety procedures, company policies and local laws at all times.
– Report any behaviour or situations that feel unsafe or uncomfortable to the art fair team.

Unacceptable behaviour includes, but is not limited to: 

– Harassment, bullying, or discrimination of any kind – whether verbal, physical, or visual.
– Attending the fair under the excessive influence of alcohol or other substances.
– Engaging in illegal activities.
– Failing to follow safety procedures, company policies, local law, event guidelines or staff instructions.
Wayfarers Contemporary Art Fair is committed to addressing any concerns swiftly and appropriately. If someone engages in unacceptable behaviour and does not commit to change, they will be asked to leave and may not be permitted to return. The company reserves the right to take further action, including reporting to authorities if necessary.
These measures are in place to ensure that every event remains welcoming, enjoyable, and reflective of our mission to inspire the world to own more art.
 

Purchasing art work

  • Artwork purchases are conducted solely between the customer and the Exhibitor (gallery, artist collective or artist / maker).
    If you have a question about a specific artwork, you should contact the Exhibitor directly in the first instance.
  • For aftercare queries and customer support post-purchase, please contact the Exhibitor you purchased through directly.

Image and material use rights

  • Unauthorised use of the Material may violate copyright, trademark, and other laws. You may not sell, prepare derivative works based on or modify the Material (including, without limitation, preparation of summaries of the Material or “thumbnails” of any images therein), or reproduce, publicly display, publicly perform, distribute, or otherwise use the Material in any way for any public or commercial purpose.
  • The use of the Material or any portion thereof on any other website, or in any publication, database, catalogue or compilation, or in a networked computer environment for any purpose other than personal browsing of the Website without the express prior written permission of the Company is strictly prohibited.
  • With respect to any copy you make of the Material within the scope of the limited personal license granted herein, you must retain therein, unmodified and unobscured, any and all copyright and other proprietary notices contained in the original Material.
  • The trademarks, logos and service marks (the “Marks”) displayed on the Website are owned by the Company or its partners. You are prohibited from using the Marks without the express, prior written permission of the Company or such third party. If you would like information about obtaining the Company’s permission to use the Material on your website, please email info@wayfarerscontemporaryartfair.com.
  • You are not permitted to use any robot, spider, scripts, service, software or any other automatic or manual device, tool, or process (a) for the purpose of compiling information regarding the identification, address or other attributes of any of our Customers, Clients or Users, or (b) to recreate in original or modified form any substantial portion of the Website or (c) to data mine or scrape any of the content on the Website, or (d) otherwise access or collect any of the Content, data, or information from the Website using automated means.
  • You are not permitted to (a) use services, software or any manual or automatic device, tool, or process to circumvent any restriction, condition, or technological measure that controls access to the Website in any way, including overriding any security feature or bypassing or circumventing any access or use controls of the Website, or (b) cache or archive any Content or (c) do anything that would impose an unreasonable or disproportionately large load on the Website, or (d) do anything that may disable, damage or change the appearance of the Website or interfere or attempt to interfere with the proper functioning of the Website or any transactions being conducted on or in connection with the Website.
  • If you violate any provision of these terms, your permission to use the Material and the Website automatically terminates and you must immediately destroy any copies you have made of the Material.
  • The Company respects the intellectual property of others, and we ask our Users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact: info@wayfarerscontemporaryartfair.com with the following information:
    – An electronic or physical signature of the person authorised to act on behalf of the owner of the copyright interest.
    – A description of the copyrighted work that you claim has been infringed.
    – A description of where the Material that you claim is infringing is located on the site.
    – Your address, telephone number, and email address.
    – A statement by you that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.

Force Majeure

Neither the Organiser nor any Exhibitor, Artist, Participant, Sponsor, or Visitor shall be liable for any failure to perform, delay in performing, or non-performance of its obligations under these Terms and Conditions to the extent that such failure, delay, or non-performance is caused by a Force Majeure Event.
 
A “Force Majeure Event” means any event or circumstance beyond the reasonable control of the affected party, including but not limited to:
  • Acts of God, natural disasters, earthquakes, floods, hurricanes, storms, extreme weather events, or fires;
  • Pandemics, epidemics, or widespread public health emergencies (including any government-imposed restrictions, quarantines, or health and safety measures arising therefrom);
  • War, invasion, terrorism, sabotage, civil unrest, riots, armed conflict, or acts of governmental or military authority;
  • Government actions, orders, regulations, embargoes, travel bans, lockdowns, prohibitions on public gatherings, or closure of venues;
  • Damage to or destruction of the venue, artworks, installations, or exhibition materials;
  • Disruptions to international or domestic shipping, transportation, customs clearance, or logistics networks affecting the delivery or return of artworks;
  • Strikes, lockouts, labour disputes, or industrial action (whether affecting the Organiser, Exhibitors, Artists, or third-party suppliers such as freight forwarders or installers);
  • Failure or disruption of utilities, power supply, internet, communications, or essential infrastructure;
  • Cyber-attacks, data breaches, or widespread technical failures impacting online components, ticketing, or virtual elements of the Art Fair (if applicable); or
  • Any other event that is unforeseeable and beyond the reasonable control of the party affected.
If a Force Majeure Event occurs, the affected party shall:
  1. Promptly notify the other party in writing as soon as reasonably practicable, providing reasonable details of the Force Majeure Event and its anticipated impact on the Art Fair;
  2. Use commercially reasonable efforts to mitigate the effects of the Force Majeure Event and to resume performance of its obligations as soon as possible.
In the event that the Art Fair (or any part of it) is cancelled, postponed, relocated, scaled down, or materially altered due to a Force Majeure Event, the Organiser shall have no obligation to issue any refunds of fees, booth rentals, ticket purchases, sponsorship amounts, or other payments made. All such payments shall be non-refundable. The Organiser shall not be liable for any losses, damages, costs, or expenses (whether direct, indirect, consequential, or otherwise) suffered by any Exhibitor, Artist, Participant, Sponsor, or Visitor as a result of any cancellation, postponement, relocation, scaling down, or alteration of the Art Fair due to a Force Majeure Event, including but not limited to loss of profit, anticipated sales, shipping costs, insurance premiums, travel expenses, accommodation costs, or damage to goodwill or reputation.Each party is strongly encouraged to obtain and maintain appropriate insurance coverage (including, where relevant, art transit and exhibition insurance, cancellation insurance, and business interruption insurance) to protect against potential losses arising from Force Majeure Events.This clause shall survive the termination or expiry of these Terms and Conditions.
